This software program (the "Program"), any printed materials, any on-line or electronic documentation, and any and all copies and derivative works of such software program and materials are the copyrighted work of Blizzard Entertainment, Inc., a Delaware corporation., or its suppliers. All use of the Program is governed by the terms of the End User License Agreement which is provided below ("License Agreement"). The Program is solely for use by end users according to the terms of the License Agreement. Any use, reproduction or redistribution of the Program not in accordance with the terms of the License Agreement is expressly prohibited.

END USER LICENSE AGREEMENT

1. Limited Use License. Blizzard Entertainment, Inc. ("Blizzard"), hereby grants, and by installing the Program you thereby accept, a limited, non-exclusive license and right to install and use one (1) copy of the Program for your use on either a home or portable computer. In addition, the Program has a multi-player capability that allows up to eight players per registered version of the Program to play concurrently. These additional copies of the Program are known as and referred to hereafter as Spawned Versions." You may install Spawned Versions of the Program on an unlimited number of computers. However, Spawned Versions of the Program must be played in conjunction with the registered version of the Program from which they were spawned. All of the terms and conditions of the License Agreement shall also apply to the Spawned Version of the Program, with the exception that the Spawned Version Program may be installed on as many computers as you wish. The Program also contains a Campaign Editor (the "Editor") that allows you to create custom levels or other materials for your personal use in connection with the Program ("New Materials"). All use of the Editor or any New Materials is subject to this License Agreement. The Program is licensed, not sold. Your license confers no title or ownership in the Program.

2. Ownership. All title, ownership rights and intellectual property rights in and to the Program and any and all copies thereof (including but not limited to any titles, computer code, themes, objects, characters, character names, stories, dialog, catch phrases, locations, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, any related documentation, and "applets" incorporated into the Program) are owned by Blizzard Entertainment or its licensors. The Program is protected by the copyright laws of the United States, international copyright treaties and conventions and other laws. All rights are reserved. The Program contains certain licensed materials and Blizzard's licensors may protect their rights in the event of any violation of this Agreement.

3. Responsibilities of End User. A. Subject to the Grant of License hereinabove, you may not, in whole or in part, copy, photocopy, reproduce, translate, reverse engineer, derive source code, modify, disassemble, decompile, create derivative works based on the Program, or remove any proprietary notices or labels on the Program without the prior consent, in writing, of Blizzard. B. The Program is licensed to you as a single product. Its component parts may not be separated for use on more than one computer. C. You are entitled to use the Program for your own use, but you are not entitled to: (i) sell, grant a security interest in or transfer reproductions of the Program to other parties in any way, nor to rent, lease or license the Program to others without the prior written consent of Blizzard. (ii) exploit the Program or any of its parts for any commercial purpose including, but not limited to, use at a cyber cafe, computer gaming center or any other location-based site. Blizzard may offer a separate Site License Agreement to permit you to make the Program available for commercial use; contact Blizzard for details; (iii) use or allow third parties to use the Editor and the New Materials created thereby for commercial purposes including, but not limited to, distribution of New Materials on a stand alone basis or packaged with other software or hardware through any and all distribution channels, including, but not limited to, retail sales and on-line electronic distribution without the express written consent of Blizzard; and (iv) host or provide matchmaking services for the Program or emulate or redirect the communication protocols used by Blizzard in the network feature of the Program, through protocol emulation, tunneling, modifying or adding components to the Program, use of a utility program or any other techniques now known or hereafter developed, for any purpose including, but not limited to network play over the Internet, network play utilizing commercial or non-commercial gaming networks or as part of content aggregation networks without the prior written consent of Blizzard.

4. Program Transfer. You may permanently transfer of your rights under this License Agreement, provided the recipient agrees to the terms of this License Agreement and you agree to remove the Program and any New Materials from your home or portable computer.

5. Termination. This License Agreement is effective until terminated. You may terminate the License Agreement at any time by destroying the Program and any New Materials. Blizzard may, at its discretion, terminate this License Agreement in the event that you fail to comply with the terms and conditions contained herein. In such event, you must immediately destroy the Program and any New Materials.

6. Export Controls. The Program may not be re-exported, downloaded or otherwise exported into (or to a national or resident of) any country to which the U.S. has embargoed goods, or to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Table of Denial Orders. By installing the Program, you are agreeing to the foregoing and you are representing and warranting that you are not located in, under the control of, or a national or resident of any such country or on any such list. 7. Limited Warranty. Blizzard expressly disclaims any warranty for the Program, Editor and Manual(s). The Program, Editor and Manual(s) are provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, or noninfringement. The entire risk arising out of use or performance of the Program and Manual(s) remains with the User, however Blizzard warrants up to and including 90 days from the date of your purchase of the Program that the media containing the Program shall be free from defects in material and workmanship. In the event that the media proves to be defective during that time period, and upon presentation to Blizzard of proof of purchase of the defective Program, Blizzard will at its option 1) correct any defect, 2) provide you with a product of equal or lesser value, or 3) refund your money. Some states do not allow the exclusion or limitation of implied warranties or liability for incidental damages, so the above limitations may not apply to you.

8. Limitation of Liability. NEITHER BLIZZARD, ITS PARENT, SUBSIDIARIES OR AFFILIATES SHALL BE LIABLE IN ANY WAY FOR LOSS OR DAMAGE OF ANY KIND RESULTING FROM THE USE OF THE PROGRAM OR EDITOR INCLUDING, BUT NOT LIMITED TO, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES. ANY WARRANTY AGAINST INFRINGEMENT THAT MAY BE PROVIDED IN SECTION 2-312(3) OF THE UNIFORM COMMERCIAL CODE AND/OR IN ANY OTHER COMPARABLE STATE STATUTE IS EXPRESSLY DISCLAIMED. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

9. Equitable Remedies. You hereby agree that Blizzard would be irreparably damaged if the terms of this License Agreement were not specifically enforced, and therefore you agree that Blizzard shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies with respect to breaches of this License Agreement, in addition to such other remedies as Blizzard may otherwise have available to it under applicable laws. In the event any litigation is brought by either party in connection with this License Agreement, the prevailing party in such litigation shall be entitled to recover from the other party all the costs, attorneys' fees and other expenses incurred by such prevailing party in the litigation.

10. Miscellaneous. This License Agreement shall be deemed to have been made and executed in the State of California and any dispute arising hereunder shall be resolved in accordance with the law of California. You agree that any claim asserted in any legal proceeding by one of the parties against the other shall be commenced and maintained in any state or federal court located in the State of California, County of Los Angeles, having subject matter jurisdiction with respect to the dispute between the parties. This License Agreement may be amended, altered or modified only by an instrument in writing, specifying such amendment, alteration or modification, executed by both parties. In the event that any provision of this License Agreement shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, such provision will be enforced to the maximum extent permissible and the remaining portions of this License Agreement shall remain in full force and effect. This License Agreement constitutes and contains the entire agreement between the parties with respect to the subject matter hereof and supersedes any prior oral or written agreements. I hereby acknowledge that I have read and understand the foregoing License Agreement and agree that the action of installing the Program is an acknowledgment of my agreement to be bound by the terms and conditions of the License Agreement contained herein. I also acknowledge and agree that this License Agreement is the complete and exclusive statement of the agreement between Blizzard and I and that the License Agreement supersedes any prior or contemporaneous agreement, either oral or written, and any other communications between Blizzard and myself.

ENDBENUTZER-LIZENZVEREINBARUNG

Blizzard Entertainment, Inc.("Blizzard"), räumt hiermit - und mit der Installation des Programms erklären Sie sich damit einverstanden - eine beschränkte, nicht-exklusive Lizenz ein, sowie das Recht, eine (1) Kopie des Programms zu installieren und diese zu Ihrem eigenen Gebrauch auf einem Home- oder einem portablen Computer zu benutzen. Außerdem verfügt das Programm über eine Multiplayer-Funktion, die es bis zu acht Spielern gestattet, per registrierter Version des Programms gleichzeitig zu spielen. Diese zusätzlichen Kopien des Programms werden "Spawned Versions" bzw. "abgeleitete Versionen" genannt, und unter diesem letzteren Namen wird im folgenden auch Bezug auf sie genommen. Sie dürfen abgeleitete (spawned) Versionen des Programms auf unbegrenzt vielen Computern installieren. Abgeleitete (spawned) Versionen des Programms müssen jedoch in Verbindung mit der registrierten Version des Programms gespielt werden, von der sie abstammen. Alle Begriffe und Bedingungen der Lizenzverei nbarung gelten auch für die abgeleitete (spawned) Version des Programms, mit der Ausnahme, daß das abgeleitete (spawned) Programm auf so vielen Computern installiert werden darf wie Sie wünschen. Das Programm enthält des weiteren einen Level-Editor (den "Editor"), der es Ihnen erlaubt, Levels eigenen Zuschnitts oder andere Materialien zu Ihrem persönlichen Gebrauch in Verbindung mit dem Programm ("Neue Materialien") zu erzeugen. Jede Benutzung des Editors oder alle Neuen Materialien unterliegen dieser Lizenzvereinbarung. Für das Programm wird eine Lizenz erteilt, es gilt nicht als verkauft. Ihre Lizenz verleiht keinen Rechtsanspruch oder den Besitz an dem Programm.

2. Besitz. Alle Rechtsansprüche, Besitzrechte und geistigen Eigentumsrechte an dem Programm und auf das Programm, sowie alle Kopien davon (dazu gehören, aber nicht darauf beschränkt, alle Titel, Computercode, Themen, Objekte, Charaktere, Charakternamen, Stories, Dialog, Slogans, Ausdrücke, Konzepte, Bildmaterial, Animationen, Geräusche, musikalische Kompositionen, audio-visuelle Effekte, Bedienungsmethoden, moralische Rechte, jede damit in Zusammenhang stehende Dokumentation sowie in das Programm eingebaute "applets" [spezielle Applikationen]) sind Eigentum von Blizzard Entertainment oder seinen Lizenzgebern. Das Programm ist im Rahmen der Copyright-Gesetze der Vereinigten Staaten, internationaler Copyright-Verträge und Konventionen sowie anderer Gesetze geschützt. Alle Rechte sind vorbehalten. 3. Verpflichtungen des Endbenutzers. A. An die vorstehende Lizenzgewährung gebunden, dürfen Sie weder Kopien, Fotokopien, Reproduktionen, Übersetzungen, Rückentwicklungen, Quellcode-Herleitungen, Modifikationen, Disassemblierungen, Dekompilationen oder abgeleitete Arbeiten herstellen, die ganz oder in Teilen auf dem Programm basieren, noch irgendwelche Eigentumsanzeigen oder Eigentumsetiketten auf dem Programm anbringen, ohne das vorherige, schriftliche Einverständnis von Blizzard erhalten zu haben. B. Sie haben die Lizenz für das Programm als ein einziges Produkt. Seine Bestandteile dürfen nicht zur Benutzung auf mehr als einem Computer abgetrennt werden. C. Sie sind berechtigt, das Programm zu Ihrem eigenen Gebrauch zu verwenden, Sie sind aber nicht berechtigt: (i) ohne das vorherige, schriftliche Einverständnis von Blizzard Reproduktionen des Programms in irgendeiner Weise an Dritte zu verkaufen oder zu übergeben, noch diese gegenüber Dritten zur Sicherung von Forderungen zu verwenden, noch an Dritte das Programm zu verleihen, zu vermieten, zu leasen oder die Lizenz daran zu erteilen. (ii) mit dem Programm oder irgendeinem Teil davon einen kommerziellen Zweck zu verfolgen, wozu gehört, aber nicht darauf beschränkt, seine Verwendung in einem Cyber-Café, in einem Center für Computerspiele oder an irgendeinem anderen ortsgebundenen Standort. Blizzard kann einen separaten Standort-Lizenzvertrag anbieten, der es Ihnen gestattet, das Programm für kommerzielle Zwecke verfügbar zu machen. Einzelheiten dazu erfahren Sie bei Blizzard; (iii) ohne das ausdrückliche, schriftliche Einverständnis von Blizzard den Editor und die damit geschaffenen Neuen Materialien zu kommerziellen Zwecken zu verwenden oder Dritten eine solche Verwendung zu gestatten, wozu gehört, aber nicht darauf beschränkt, die Verteilung Neuer Materialien auf einer Stand-alone-Basis oder im Paket mit anderer Software oder Hardware über alle Vertriebswege, wozu gehören, aber nicht darauf beschränkt, der Verkauf im Einzelhandel und der elektronische Online-Vertrieb; sowie (iv) ohne vorheriges, schriftliches Einverständnis von Blizzard als Spielleiter (Host) für das Programm zu fungieren oder für dieses Dienste anzubieten, die der Initiierung von Spielen dienen, noch Kommunikationsprotokolle zu emulieren oder weiterzuleiten, die von Blizzard im Netzwerk-Feature des Programms verwendet werden, und dazu Methoden wie Protokollemulation, Tunneling, die Modifizierung oder Hinzufügung von Komponenten zum Programm, ein Utility-Programm oder irgendeine andere schon bekannte oder zukünftig entwickelte Technik zu benutzen. Dies gilt für jeden Zweck, dazu gehören, aber nicht darauf beschränkt, Netzwerkspiele über das Internet, Netzwerkspiele, die kommerzielle oder nicht-kommerzielle Gaming-Netzwerke verwenden oder die zu Content-Aggregation-Netzwerken gehören.

4. Programm-Transfer. Sie dürfen auf Dauer Ihre gesamten Rechte übertragen, die sich aus dieser Lizenzvereinbarung ergeben, unter der Voraussetzung, daß der Empfänger den Bedingungen dieser Lizenzvereinbarung zustimmt und Sie damit einverstanden sind, das Programm und alle Neuen Materialien von Ihrem Home- oder portablen Computer zu entfernen.

5. Ablauf. Diese Lizenzvereinbarung bleibt bis zu ihrem Ablauf in Kraft. Sie können die Lizenzvereinbarung jederzeit beenden, indem Sie das Programm und alle Neuen Materialien vernichten. Blizzard kann nach eigenem Ermessen diese Lizenzvereinbarung in dem Fall beenden, daß Sie gegen die hierin enthaltenen Bedingungen verstoßen. In diesem Fall sind Sie verpflichtet, das Programm und alle Neuen Materialien unverzüglich zu vernichten. 6. Export-Beschränkungen. Das Programm darf nicht reexportiert, heruntergeladen oder in anderer Weise in irgendein Land (oder an einen seiner Staatsbürger oder Einwohner) exportiert werden, das von den USA mit einem Embargo für Güter belegt worden ist, oder an jemanden, der sich auf der Liste der "Specially Designated Nationals" des U.S. Finanzministeriums oder der "Table of Denial Orders" des U.S. Handelsministeriums befindet. Mit der Installation des Programms stimmen Sie dem vorstehenden zu, und Sie erklären und garantieren, daß Sie sich nicht in einem solchen Land befinden, kein Staatsbürger oder Einwohner eines solchen sind und nicht der Kontrolle irgendeiner solchen Liste unterliegen.

7. Garantieeinschränkungen. Blizzard lehnt ausdrücklich jede Gewährleistung für das Programm, den Editor und Manual(s) ab. Das Programm, Editor und Manual(s) werden "wie vorliegend" ausgeliefert ohne jegliche Gewährleistung, weder ausdrücklich erklärter noch stillschweigend eingeräumter Art, einschließlich, aber nicht darauf beschränkt, stillschweigender Garantien bezüglich Verkäuflichkeit, der Eignung für einen bestimmten Zweck oder eines Nicht-Verstoßes gegen ein Gesetz. Das gesamte Risiko, das sich aus der Benutzung oder der Ausführung des Programms und des/der Manual(s) ergibt, verbleibt beim Benutzer. Blizzard gewährleistet jedoch, daß die Medien, auf denen sich das Programm befindet, für die Dauer von 180 Tagen ab dem Kaufdatum des Programms frei von Mängeln in Bezug auf Material und Verarbeitung sind. In dem Fall, wo sich das Medium innerhalb dieser Periode als defekt erweist, und nachdem Blizzard der Erwerb des defekten Programms belegt worden ist, kann Blizzard optional wählen, ob es 1) einen Mangel behebt, 2) Ihnen ein Produkt von gleichem oder geringerem Wert liefert oder 3) Ihr Geld zurückerstattet.

8. Haftungsbeschränkung. WEDER BLIZZARD, NOCH SEINE MUTTERGESELLSCHAFT, TOCHTER- ODER ZWEIGGESELLSCHAFTEN ÜBERNEHMEN IN IRGENDEINER WEISE EINE HAFTUNG FÜR VERLUST ODER SCHADEN JEDWEDER ART, DER AUS DER BENUTZUNG DES PROGRAMMS ODER EDITORS RESULTIERT, EINSCHLIESSLICH, ABER NICHT DARAUF BESCHRÄNKT, VERLUSTS DES FIRMENANSEHENS, BETRIEBSUNTERBRECHUNG, COMPUTERAUSFALLS ODER -FUNKTIONSSTÖRUNG ODER JEGLICHEN ANDEREN WIRTSCHAFTLICHEN SCHADENS ODER VERLUSTS.

9. Billige Rechtsmittel. Sie stimmen hiermit zu, daß Blizzard irreparable Schäden davontragen würde, wenn den Bedingungen dieser Lizenzvereinbarung nicht unter allen Umständen Geltung verschafft wird. Deshalb sind Sie damit einverstanden, daß Blizzard ohne Einschränkung, ohne weitere Sicherheit oder einen Nachweis für entstandene Schäden berechtigt wird, billige Rechtsmittel geltend zu machen, hinsichtlich der Verstöße gegen diese Lizenzvereinbarung und zusätzlich zu solchen Rechtsmitteln, die Blizzard im Rahmen der anwendbaren Gesetze ohnehin zur Verfügung stehen.

10. Verschiedenes. Diese Lizenzvereinbarung soll angenommen werden, als ob sie im France erstellt und unterzeichnet worden wäre; und jeder im folgenden sich ergebende Konflikt soll in Übereinstimmung mit dem kalifornischen Gesetz geregelt werden. Sie sind damit einverstanden, daß jeder Anspruch, der in irgendeinem gesetzlichen Verfahren von einer der Vertragsparteien gegen die andere geltend gemacht wird, vor einem staatlichen oder bundesstaatlichen Gericht, das sich im France, befindet, anhängig gemacht wird, in dessen Zuständigkeitsbereich der betreffende Rechtsstreit zwischen den Parteien fällt. Diese Lizenzvereinbarung kann nur ergänzt, verändert oder eingeschränkt werden, indem eine schriftliche Urkunde erstellt wird, in der eine solche Ergänzung, Veränderung oder Einschränkung spezifiziert wird, und die von beiden Parteien unterzeichnet wird. Im dem Fall, daß irgendeine Bestimmung dieser Lizenzvereinbarung von einem Gericht oder einem Schiedsgericht, in dessen Zuständigkeit der Rechtsstreit fällt, für ungültig erklärt wird, soll diese Bestimmung im zulässigen Rahmen so weit wie möglich in Kraft bleiben, und die übrigen Teile dieser Lizenzvereinbarung sollen davon unberührt und vollständig wirksam bleiben. Diese Lizenzvereinbarung begründet und enthält alle rechtlichen Vereinbarungen zwischen den Parteien in bezug auf ihren Vertragsgegenstand und hebt alle früheren mündlichen oder schriftlichen Vereinbarungen auf. Ich bestätige hiermit, die vorstehende Lizenzvereinbarung gelesen zu haben, sie zu verstehen und damit einverstanden zu sein, daß die Aktion der Programminstallation eine Bestätigung meines Einverständnisses darstellt, an die Bedingungen gebunden zu sein, die in der Lizenzvereinbarung enthalten sind. Ich bestätige außerdem und erkläre mich damit einverstanden, daß diese Lizenzvereinbarung die vollständige und ausschließliche vertragliche Abmachung darstellt, die zwischen Blizzard und mir besteht, und daß die Lizenzvereinbarung jede frühere oder gegenwärtige Vereinbarung, ob schriftlich oder mündlich, und jede andere Mitteilung zwischen Blizzard und mir aufhebt.

Subject to the Grant of License hereinabove, you may not, in whole or in part, copy, photocopy, reproduce, translate, reverse engineer, derive source code, modify, disassemble, decompile, create derivative works based on the Program, or remove any proprietary notices or labels on the Program without the prior consent, in writing, of Blizzard. B. The Program is licensed to you as a single product. Its component parts may not be separated for use on more than one computer. C. You are entitled to use the Program for your own use, but you are not be entitled to: (i) sell, grant a security interest in or transfer reproductions of the Program to other parties in any way, nor to rent, lease or license the Program to others without the prior written consent of Blizzard. (ii) exploit the Program or any of its parts for any commercial purpose including, but not limited to, use at a cyber café, computer gaming center or any other location-based site. Blizzard may offer a separate Site License Agreement to permit you to make the Program available for commercial use; contact Blizzard for details; (iii) use or allow third parties to use the Editor and the New Materials created thereby for commercial purposes including, but not limited to, distribution of New Materials on a stand alone basis or packaged with other software or hardware through any and all distribution channels, including, but not limited to, retail sales and on-line electronic distribution without the express written consent of Blizzard; and (iv) host or provide matchmaking services for the Program or emulate or redirect the communication protocols used by Blizzard in the network feature of the Program, through protocol emulation, tunneling, modifying or adding components to the Program, use of a utility program or any other techniques now known or hereafter developed, for any purpose including, but not limited to network play over the Internet, network play utilizing commercial or non-commercial gaming networks or as part of content aggregation networks without the prior written consent of Blizzard.

4. Program Transfer. You may permanently transfer all of your rights under this License Agreement, provided the recipient agrees to the terms of this License Agreement and you agree to remove the Program and any New Materials from your home or portable computer.

7. Limited Warranty. Blizzard expressly disclaims any warranty for the Program, Editor and Manual(s). The Program, Editor and Manual(s) are provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, or noninfringement. The entire risk arising out of use or performance of the Program and Manual(s) remains with the User, however Blizzard warrants up to and including 90 days from the date of your purchase of the Program that the media containing the Program shall be free from defects in material and workmanship. In the event that the media proves to be defective during that time period, and upon presentation to Blizzard of proof of purchase of the defective Program, Blizzard will at its option 1) correct any defect, 2) provide you with a product of equal or lesser value, or 3) refund your money. Some states do not allow the exclusion or limitation of implied warranties or liability for incidental damages, so the above limitations may not apply to you.

8. Limitation of Liability. NEITHER BLIZZARD, DAVIDSON & ASSOCIATES, INC., ITS PARENT, SUBSIDIARIES OR AFFILIATES SHALL BE LIABLE IN ANY WAY FOR LOSS OR DAMAGE OF ANY KIND RESULTING FROM THE USE OF THE PROGRAM OR EDITOR INCLUDING, BUT NOT LIMITED TO, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES.

10. Miscellaneous. This License Agreement shall be deemed to have been made and executed in France, the State of California and any dispute arising hereunder shall be resolved in accordance with the law of CaliforniaFrance. You agree that any claim asserted in any legal proceeding by one of the parities against the other shall be commenced and maintained in any state or federal court located in the State of California, County of Los AngelesFrance, which shall have having subject matter jurisdiction with respect to the dispute between the parties. This License Agreement may be amended, altered or modified only by an instrument in writing, specifying such amendment, alteration or modification, executed by both parties. In the event that any provision of this License Agreement shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, such provision will be enforced to the maximum extent permissible and the remaining portions of this License Agreement shall remain in full force and effect. This License Agreement constitutes and contains the entire agreement between the parties with respect to the subject matter hereof and supersedes any prior oral or written agreements. I hereby acknowledge that I have read and understand the foregoing License Agreement and agree that the action of installing the Program is an acknowledgment of my agreement to be bound by the terms and conditions of the License Agreement contained herein. I also acknowledge and agree that this License Agreement is the complete and exclusive statement of the agreement between Blizzard and I and that the License Agreement supersedes any prior or contemporaneous agreement, either oral or written, and any other communications between Blizzard and myself.

Puede instalar Versiones Reproducidas del Programa en un número ilimitado de Ordenadores. Sin embargo, las Versiones Reproducidas del Programa deben jugarse junto con la versión registrada del Programa desde el que fueron generadas. Todos los términos y condiciones del Acuerdo de Licencia se aplicarán a la Versión Generada del Programa, con la excepción de que el Programa de Versión Generada puede ser instalado en tantos ordenadores como se desee. El Programa también contiene un Editor de Nivel (el Editor) que le permite crear escenarios personalizados u otros materiales para su uso personal en relación con el Programa(Nuevo Material). 2. Propiedad. C. Vd. Tiene derecho a utilizar el Programa para su propio uso, pero Vd. está privado del derecho a:

(i) vender, conceder un interés de seguridad en el Programa o transferir reproducciones del mismo a otras partes de cualquier modo, ni alquilar, llevar a cabo un contrato de arrendamiento o autorizar el Programa a otros sin previo consentimiento por escrito de Blizzard;

(ii) explotar el Programa o cualquiera de sus partes con cualquier objetivo comercial, incluyendo, pero sin limitarse al uso en un café cibernauta, en un centro de juegos por ordenador o en cualquier otro lugar con una base de ubicación. Blizzard puede ofrecer un Acuerdo de Lugar de Licencia separado para permitirle tener el Programa disponible para su uso comercial; contacte a Blizzard para obtener información adicional;

(iii) utilizar o permitir a terceras partes el uso del Editor y de los Materiales Nuevos creados con objetivos comerciales, incluyendo , pero sin limitarse a, distribución de Materiales Nuevos de modo individual o empaquetado con otro software o hardware a través de cualquier canal de distribución, incluyendo, pero sin limitarse a tiendas minoristas y distribución electrónica en línea sin el consentimiento expreso por escrito de Blizzard; y

(iv) albergar o proveer con servicio de promoción del Programa o emular o redirigir los protocolos de comunicación utilizados por Blizzard en la red del programa, a través de la emulación del protocolo, abriendo, modificando o añadiendo componentes al Programa, uso de un programa de utilidad o de cualquier otras técnicas que sean conocidas en la actualidad o desarrolladas en lo sucesivo con cualquier fin incluyendo, pero sin limitarse a juego en la red de Internet, juego con la red utilizando redes comerciales o no comerciales de juegos o como parte de redes globales de contenido sin previo consentimiento escrito por parte de Blizzard.

4. Transferencia de Programa. Vd. Puede transferir todos sus derechos de este Acuerdo de Licencia, siempre y cuando el receptor esté de acuerdo con las condiciones de este Acuerdo de Licencia y Vd. Esté de acuerdo en deshacerse del Programa y de cualquier Material Nuevo de su casa u ordenador portátil.

5. Conclusión. Este Contrato de Licencia será efectivo hasta que concluya. Vd. Puede concluir el Acuerdo de Licencia en cualquier momento mediante la destrucción del Programa y de cualesquiera Materiales Nuevos. Blizzard puede, según su criterio, concluir este Acuerdo de Licencia en el caso en el que Vd. no cumpliese los términos y condiciones incluidos en el mismo. En ese caso, Vd. deberá destruir el Programa inmediatamente y cualquier Material Nuevo.

6. Controles de exportación. El Programa no puede ser re-exportado, trasvasado o exportado de otro modo a (o a un nacional o residente de) cualquier país al que EE.UU. tiene bienes embargados o a cualquier persona en la Lista del Departamento de Comercio de Ordenes Denegadas. Al instalar el Programa, Vd. está acatando lo anterior y representando y garantizando Vd. no se encuentra, bajo el control de, o un nacional o un residente de cualquiera de dichos países o en dicha Lista.

7. Garantía limitada. Blizzard niega expresamente cualquier garantía para el Programa, Editor y Manual(es). El Programa, Editor y Manual(es) son facilitados sin ninguna garantía de ningún tipo, ya sea expresa o implícita, incluyendo, pero sin limitarse a las garantías implícitas del comercio, capacidad para una finalidad particular, o no infracción. Todo el riesgo que surge del uso o la ejecución del Programa y del Manual(es) se queda con el Usuario, sin embargo Blizzard garantiza lo siguiente: 90 días desde la fecha de su compra del Programa que la difusión del programa estará libre de defectos en el material y en habilidad profesional. 8. Limitación de Responsabilidad. NI BLIZZARD, SU EMPRESA MATRIZ, FILIALES O AFILIADAS TENDRÁN RESPONSABILIDAD ALGUNA EN NINGÚN MODO POR PERDIDA O PERJUICIO DE CUALQUIER TIPO QUE RESULTE DEL USO DEL PROGRAMA O EDITOR, INCLUYENDO, PERO SIN LIMITARSE A, PERDIDA DE BUENA VOLUNTAD, INTERRUPCION DEL TRABAJO, FALLO O DESORDEN DEL ORDENADOR, O CUALQUIER Y TODOS LOS OTROS PERJUICIO COMERCIALES O PERDIDAS.

9. Remedios equitativos. Por el presente Vd. acuerda que Blizzard quedaría perjudicado irreparablemente si los términos de este Acuerdo de Licencia no se cumplieran específicamente, y por ello acuerda que Blizzard tendrá derecho, sin obligación, otra seguridad, o prueba de daños, a recurrir a recursos equitativos convenientes en relación con el incumplimiento de este Acuerdo de Licencia, además de otros remedios que Blizzard tenga disponibles en virtud de leyes aplicables.

10. Misceláneos. Se considerará que este Acuerdo de Licencia se ha llevado a cabo y ha sido firmado en France y cualquier disputa que surja del mismo será resuelta en virtud de las Leyes de France. Vd. acuerda que cualquier denuncia reivindicada en cualquier proceso legal por cualquiera de las partes contra la otra será comenzado y mantenido en cualquier Estado o tribunal federal ubicado en France, que tenga como tema base la jurisdicción relación con la disputa entre las partes. Este Acuerdo de Licencia puede ser enmendado, alterado o modificado sólo por medio de un documento por escrito, especificando dicha enmienda, alteración o modificación, firmado por ambas partes. En el caso en el que cualquier tribunal de jurisdicción competente dictamine que cualquier estipulación de este Acuerdo de Licencia no se puede hacer cumplir, dicha estipulación se cumplirá en lo máximo permisible y las partes restantes de este Acuerdo de Licencia seguirán siendo plenamente vigentes y efectivas. Este Acuerdo de Licencia constituyes y contiene todo el acuerdo entre las partes con respecto al tema base del mismo y sustituye a cualquier otro acuerdo oral o escrito anterior. Por el presente reconozco que he leído y comprendido el anterior Acuerdo de Licencia y estoy de acuerdo en que la acción de instalar el Programa debe ser vinculada por los término y condiciones del Acuerdo de Licencia contenido en el presente. Asimismo, reconozco y admito que este Acuerdo de Licencia es la declaración completa y exclusiva del acuerdo entre Blizzard y Yo y que el Acuerdo de Licencia sustituye cualquier acuerdo anterior o contemporáneo, ya sea oral o escrito, y cualquier otra comunicación entre Blizzard y yo.

Vous avez le droit d'utiliser ce logiciel mais Blizzard Entertainment en conserve les droits et le secret de fabrication. Accord de Licence Utilisateur Final

1-Limites de l'accord de licence : Blizzard Entertainment ne vous autorise à utiliser ce logiciel que sur un seul ordinateur. De plus, ce logiciel comporte une option multijoueur permettant à un maximum de 8 joueurs par CD de s'affronter. Bien que vous soyez a priori autorisés à installer ces "CD partagés" sur autant d'ordinateurs que vous le souhaitez, les versions partagées que vous installez doivent toujours être en relation directe avec le logiciel acheté et enregistré en bonne et due forme. Tous les termes de cet accord de licence sont applicables aux logiciels utilisés en jeu normal comme à ceux partagés lors du jeu en multijoueur. Le programme comporte également un Editeur de Cartes qui vous permet de créer des niveaux personnalisés et autres éléments réservés à un usage personnel. Les termes de cet accord de licence sont également applicables à l'utilisation de cet Editeur de Cartes.Vous utilisez ce logiciel sous licence, mais le programme ne vous est en aucun cas vendu. Cette licence ne vous confère aucun droit de propriété dudit programme.

2-Propriété : Tous les droits de propriétés matérielle et intellectuelle concernant le logiciel (comprenant, non exhaustivement les titres, les codes sources programmes, les objets, les thèmes, les personnages, les noms des personnages, les histoires, les dialogues, les phrases d'accroche, les lieux, les concepts, les visuels, les animations, les sons, la musique, les effets audiovisuels, les méthodes de travail, les droits moraux, toute documentation annexe) sont la propriété de Blizzard Entertainment et de ceux qui vous accordent cette licence. Ce logiciel est protégé par les lois en vigueur aux Etats Unis, et la loi Internationale sur le copyright. Tous droits réservés. Ce programme contient des éléments sous licence et Blizzard Entertainment s'engage à protéger les droits des personnes lui ayant concédé ces licences en cas de violation de l'Accord.

3-Responsabilité du consommateur final : A. 4-Transfert du logiciel : Si vous transmettez ce logiciel, vous devez transférer tous ses composants, y compris sa documentation, et effacer toutes les copies qui restent sur votre équipement informatique. Votre licence prend fin automatiquement dès lors que vous transmettez ce logiciel.

5-Fin de l'accord de licence : L'accord de licence est effectif jusqu'à ce qu'il prenne fin. L'accord de licence peut prendre fin à tout moment si vous détruisez le logiciel et les éléments qui l'accompagnent. Blizzard peut choisir de mettre fin à cet accord de licence à tout moment si vous ne vous pliez pas aux conditions et termes de l'accord. Dans ce cas, vous devrez détruire le logiciel et les éléments annexes.

6-Contrôle des exportations : Ce logiciel ne doit pas être exporté, téléchargé ou envoyé vers des pays ou des résidents des pays avec lesquels les Etats-Unis appliquent une politique d'embargo ou quiconque du Treasury Department's List of Specially Designated Nationals ot the U.S. Commerce Department's Table of Denial Orders. En installant ce logiciel, vous reconnaissez n'appartenir ou n'être sous le contrôle d'aucun de ces pays ou de cette liste.

7-Limites de la garantie Blizzard ne reconnaît aucune garantie pour le logiciel, l'éditeur et le ou les manuel(s). Le logiciel, l'éditeur et le ou les manuel(s) sont fournis en l'état sans garantie d'aucune sorte y compris mais non exhaustivement la garantie de qualité loyale et marchande Tous les risques liés à l'utilisation du logiciel et du ou des manuel(s) incombent à l'utilisateur final, mais Blizzard Entertainment laisse une période de 90 jours à l'utilisateur pour signaler tout défaut de fabrication du produit. Dans le cas où le défaut de fabrication serait prouvé dans ce délai de 90 jours Blizzard pourra selon les cas, et sur présentation de la preuve d'achat du produit : 1) Corriger le défaut, 2) Remplacer le logiciel par un produit équivalent ou de moindre valeur 3) Vous rembourser.

8-Limites de la responsabilité : En aucun cas Blizzard, ses filiales ou partenaires ne pourront être tenus pour responsables d'une perte ou d'un préjudice subit lors de l'utilisation du logiciel ou de l'éditeur y compris mais non exhaustivement la perte de bonne foi, l'arrêt du travail, l'arrêt ou le dysfonctionnement de votre ordinateur, ou toute autre perte ou préjudice commercial.

9-Recours légal : Vous agréez avec le fait que Blizzard serait lésé si les termes de cet accord de licence n'étaient pas expressément respectés. Vous acceptez de ce fait que Blizzard est habilité à s'approprier un recours légal en cas de violation de cet accord de licence, en plus des autres recours que Blizzard peut exercer selon les lois applicables.

10-Annexes : Cet Accord de Licence a été réalisé suivant les lois de France et doit par conséquent se référer à ces lois en cas de contestation ou de problème. Vous acceptez le fait que quel que soit le parti initiant les poursuites judiciaires, le conflit doit être réglé dans un tribunal situé dans France. Cet Accord de Licence ne peut être amendé, modifié ou adapté que par un acte écrit précisant l'amendement, l'adaptation ou la modification convenu entre les deux parties. Je reconnais avoir pris connaissance et compris les termes du présent Accord de Licence et reconnaît qu'installer ce logiciel équivaut à donner mon accord sur tous les termes de l'Accord de Licence précisés ici. Je reconnais également que cet Accord de Licence résulte d'un accord complet et exclusif entre Blizzard Entertainment et moi-même, et que cet Accord de Licence prévaut sur tout accord ayant préalablement été conclu entre Blizzard Entertainment et moi-même.

Il programma è protetto dalle leggi sul copyright degli Stati Uniti, dai trattati internazionali sul copyright e da convenzioni e altre leggi. Tutti i diritti riservati. 4. Trasferimento del programma. 5. Termine. Questo accordo di licenza rimane in vigore fino a quando non viene terminato. 6. Controlli sull'esportazione. 9. Rimedi appropriati. Riconoscete qui il fatto che Blizzard sarebbe irrimediabilmente danneggiata se i termini di questo accordo di licenza non fossero protetti, pertanto accordate a Blizzard il diritto, senza alcun limite, di applicare rimedi applicati in rispetto a quanto contemplato da questo accordo di licenza, oltre a tutta una serie di altri rimedi che potrebbero essere comunque a disposizione di Blizzard secondo le leggi in vigore.

10. Varie. Questo accordo di licenza è stato concepito e messo in atto nello France e qualsiasi disputa esso riguardante deve essere risolta in accordo alle leggi France. Accettate che una qualsiasi causa in un qualsiasi procedimento penale di una delle parti contro l'altra sarà sotto la completa competenza di una qualsiasi corte statale o federale ubicata nello France, che avrà giurisdizione rispetto alla disputa tra le due parti. Questo accordo di licenza può essere emendato, alterato o modificato solamente in maniera scritta, specificando l'emendamento, l'alterazione o la modifica e facendolo accettare da entrambe le parti. Nel caso che uno qualsiasi dei termini di questo accordo di licenza venisse ritenuto inapplicabile da una corte o da un altro tribunale di giurisdizione competente, tutta la parte restante dell'accordo di licenza resterà in vigore ed effettiva. Questo accordo di licenza costituisce e contiene l'intero accordo tra le parti rispetto alla materia di trattazione e sopravanza, annullandolo, qualsiasi accordo orale o scritto preesistente. Affermo di aver letto e compreso tutto l'accordo di licenza soprastante e di essere a conoscenza del fatto che installando il programma io accetto di sottopormi alle limitazioni e ai termini di detto accordo. Riconosco anche che l'accordo di licenza rappresenta l'unico ed esclusivo accordo tra me e Blizzard e che esso sostituisce qualsiasi altro accordo preesistente o contemporaneo, sia esso orale o scritto, e qualsiasi altra comunicazione intercorsa tra me e Blizzard.

YOU SHOULD CAREFULLY READ THE FOLLOWING END USER LICENSE AGREEMENT BEFORE INSTALLING THIS SOFTWARE PROGRAM. BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE PROGRAM, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, PROMPTLY RETURN THE UNUSED SOFTWARE PROGRAM TO THE PLACE OF PURCHASE OR CONTACT BLIZZARD ENTERTAINMENT LTD. FOR A FULL REFUND OF THE PURCHASE PRICE WITHIN 7 DAYS OF THE ORIGINAL PURCHASE OR THE PERIOD AS PRESCRIBED BY THE LAW, WHICH IS LONGER.

This software program including any and all subsequent patches (the "Program"), any printed materials, any on-line or electronic documentation, and any and all copies and derivative works of such software program and materials are the copyrighted work of Blizzard Entertainment, Inc., a corporation organized in the State of Delaware, U.S.A., or its suppliers. All use of the Program is governed by the terms of the End User License Agreement which is provided below ("License Agreement"). The Program is solely for use by end users according to the terms of the License Agreement. Any use, reproduction, or redistribution of the Program not in accordance with the terms of the License Agreement is expressly prohibited.

END USER LICENSE AGREEMENT

1. Limited Use License. Blizzard Entertainment Inc. ("Blizzard") hereby grants, and by installing the Program you thereby accept, a limited, non-exclusive license and right to install and use one (1) copy of the Program for your use on a home, business, or portable computer. In addition, the Program has a multi-player capability that allows up to eight players per registered version of the Program to play concurrently. These additional copies of the Program are known as and referred to hereafter as "Spawned Versions." You may install Spawned Versions of the Program on an unlimited number of computers. However, Spawned Versions of the Program must be played in conjunction with the registered version of the Program from which they were spawned. All of the terms and conditions of the License Agreement shall also apply to the Spawned Version of the Program, with the exception that the Spawned Version Program may be installed on as many computers as you wish. The Program also contains a Campaign Editor (the "Editor") that allows you to create custom levels or other materials for your personal use in connection with the Program ("New Materials"). All use of the Editor or any New Materials is subject to this License Agreement. The Program is licensed, not sold. Your license confers no title or ownership in the Program.

2. Ownership. All title, ownership rights, and intellectual property rights in and to the Program and any and all copies thereof (including, but not limited to, any titles, computer code, themes, objects, characters, character names, stories, dialog, catch phrases, locations, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, any related documentation, and "applets" incorporated into the Program) and any New Materials are owned by Blizzard or its licensors. The Program is protected by the copyright laws of the United States, international copyright treaties, and conventions and other laws. All rights are reserved. The Program contains certain licensed materials, and Blizzard's licensors may protect their rights in the event of any violation of this Agreement.

3. Responsibilities of End User. A. Subject to the Grant of License hereinabove, you may not, in whole or in part, copy, photocopy, reproduce, sublicense, translate, reverse engineer, derive source code, modify, disassemble, decompile, create a source code equivalent, create derivative works based on the Program, or remove any proprietary notices or labels on the Program, or allow others to do so, without the prior consent, in writing, of Blizzard. B. The Program is licensed to you as a single product. Its component parts may not be separated for use on more than one computer. C. You are entitled to use the Program for your own use, but you are not entitled to: (i) sell, grant a security interest in, or transfer reproductions of the Program to other parties in any way, nor to rent, lease, or license the Program to others without the prior written consent of Blizzard; (ii) exploit the Program or any of its parts for any commercial purpose including, but not limited to, use at a cyber cafe, computer gaming center, or any other location-based site. Blizzard may offer a separate Site License Agreement to permit you to make the Program available for commercial use; contact Blizzard for details; (iii) use or allow third parties to use the Editor and the New Materials created thereby for commercial purposes including, but not limited to, distribution of New Materials on a stand-alone basis or packaged with other software or hardware through any and all distribution channels, including, but not limited to, retail sales and on-line electronic distribution without the express written consent of Blizzard; (iv) host or provide matchmaking services for the Program, or emulate or redirect the communication protocols used by Blizzard in the network feature of the Program, through protocol emulation, tunneling, modifying or adding components to the Program, use of a utility program, or any other techniques now known or hereafter developed, for any purpose including, but not limited to, network play over the Internet, network play utilizing commercial or non-commercial gaming networks, or as part of content aggregation networks without the prior written consent of Blizzard.

6. Export Controls. The Program may not be re-exported, downloaded, or otherwise exported into (or to a national or resident of) any country to which the U.S. has embargoed goods, or to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Table of Denial Orders. By installing the Program, you are agreeing to the foregoing, and you are representing and warranting that you are not located in, under the control of, or a national or resident of any such country or on any such list.

7. Limited Warranty. Blizzard expressly disclaims any warranty for the Program, Editor, and Manual(s). The Program, Editor, and Manual(s) are provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, or noninfringement. The entire risk arising out of use or performance of the Program, Editor, and Manual(s) remains with the User; however Blizzard warrants up to and including ninety (90) days from the date of your purchase of the Program that the media containing the Program shall be free from defects in material and workmanship. In the event that the media proves to be defective during that time period, and upon presentation to Blizzard of proof of purchase of the defective Program, Blizzard will at its option 1) correct any defect, 2) provide you with a product of equal or lesser value, or 3) refund your money. Some states do not allow the exclusion or limitation of implied warranties or liability for incidental damages, so the above limitations may not apply to you.

8. Limitation of Liability. NEITHER BLIZZARD, ITS PARENT, SUBSIDIARIES, OR AFFILIATES SHALL BE LIABLE IN ANY WAY FOR LOSS OR DAMAGE OF ANY KIND RESULTING FROM THE USE OF THE PROGRAM, THE EDITOR, OR BLIZZARD'S ONLINE GAME NETWORK, BATTLE.NET, OR OTHER ON-LINE PROVIDER AUTHORIZED BY BLIZZARD, INCLUDING, BUT NOT LIMITED TO, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES. ANY WARRANTY AGAINST INFRINGEMENT THAT MAY BE PROVIDED IN SECTION 2-312(3) OF THE UNIFORM COMMERCIAL CODE AND/OR IN ANY OTHER COMPARABLE STATE STATUTE IS EXPRESSLY DISCLAIMED. FURTHER, BLIZZARD SHALL NOT BE LIABLE IN ANY WAY FOR THE LOSS OR DAMAGE TO ACCOUNTS, STATISTICS, OR USER PROFILE INFORMATION STORED ON BATTLE.NET OR ANOTHER ON-LINE PROVIDER AUTHORIZED BY BLIZZARD. BLIZZARD SHALL NOT BE RESPONSIBLE FOR ANY INTERRUPTIONS OF SERVICE ON BATTLE.NET OR OTHER ON-LINE PROVIDER AUTHORIZED BY BLIZZARD INCLUDING, BUT NOT LIMITED TO, ISP DISRUPTIONS, SOFTWARE OR HARDWARE FAILURES, OR ANY OTHER EVENT WHICH MAY RESULT IN A LOSS OF DATA OR DISRUPTION OF SERVICE. Some states do not allow the exclusion or limitation of incidental or consequential damages, or allow limitations on how long an implied warranty lasts, so the above limitations may not apply.

9. Equitable Remedies. You hereby agree that Blizzard would be irreparably damaged if the terms of this License Agreement were not specifically enforced, and therefore you agree that Blizzard shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies with respect to breaches of this License Agreement, in addition to such other remedies as Blizzard may otherwise have available to it under applicable laws. In the event any litigation is brought by either party in connection with this License Agreement, the prevailing party, in such litigation shall be entitled to recover from the other party all the costs, attorneys' fees and other expenses incurred by such prevailing party in the litigation.

10. Limitations on License. Nothing in this License Agreement shall preclude you from making or authorizing the making of another copy or adaptation of the Program provided, however, that (1) such new copy or adaptation is created as an essential step in your utilization of the Program in accordance with the terms of this License Agreement and for NO OTHER PURPOSE; or (2) such new copy or adaptation is for archival purposes ONLY and all archival copies are destroyed in the event of your Transfer of the Program, the Termination of this Agreement, or other circumstances under which your continued use of the Program ceases is no longer in compliance with the terms of this License Agreement.

11. Miscellaneous. This License Agreement shall be deemed to have been made and executed in the Republic of Korea, and any dispute arising hereunder shall be resolved in accordance with the law of the Republic of Korea. You agree that any claim asserted in any legal proceeding by one of the parties against the other shall be commenced and maintained in Seoul Central District Court, which shall have subject matter jurisdiction with respect to the dispute between the parties. This License Agreement may be amended, altered, or modified only by an instrument in writing, specifying such amendment, alteration, or modification, executed by both parties. In the event that any provision of this License Agreement shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, such provision will be enforced to the maximum extent permissible, and the remaining portions of this License Agreement shall remain in full force and effect. This License Agreement constitutes and contains the entire agreement between the parties with respect to the subject matter hereof and supersedes any prior oral or written agreements.

I hereby acknowledge that I have read and understand the foregoing License Agreement and agree that the action of installing the Program is an acknowledgment of my agreement to be bound by the terms and conditions of the License Agreement contained herein. I also acknowledge and agree that this License Agreement is the complete and exclusive statement of the agreement between Blizzard and me and that the License Agreement supersedes any prior or contemporaneous agreement, either oral or written, and any other communications between Blizzard and me.

Contate Blizzard para detalhes; (o iii) Usar ou permitir que terceiros usem o Editor e os Materiais Novos criados desse modo para finalidades comerciais, incluindo mas não limitados a, distribuição de Materiais Novos em uma base sozinha, ou empacotados com outro software ou hardware com alguns ou todos os canais de distribuição, incluindo mas não limitando às vendas de varejo e a distribuição eletrônica on-line sem o expresso consentimento escrito da Blizzard; e (iv) Anfitriar ou fornecer serviço de emparceiramento para o Programa ou emular ou dirigir de novo o protocolo de comunicação usado na característica rede do Programa, através de protocolo emulativo, tunear, modificar ou adicionar componente ao Programa, usar de um Programa de utilidade ou alguma outra técnica agora conhecida, ou daqui por diante desenvolvida, para alguma finalidade incluindo, mas não limitado a, jogo na rede sobre a Internet, jogo utilizando rede comercial ou não comercial , ou como parte do conteúdo de uma agregação da rede sem prévio consentimento por escrito da Blizzard.

4. Transferência Do Programa. Você pode permanentemente transferir todos seus direitos sob este Acordo de Licença, desde que o receptor concorde com os termos deste Acordo de Licença, e você concorde remover o Programa e todos os Materiais Novos de seu computador ou do computador portátil.

5. Terminação. Este Acordo de Licença é eficaz até terminado. Você pode terminar o Acordo de Licença a qualquer hora destruindo o Programa e todos os Materiais Novos. A Blizzard pode, em sua discrição, terminar este Acordo de Licença caso você não cumpra com os termos e as circunstâncias contidos neste. Em tal evento, você deve imediatamente destruir o Programa e todos os Materiais Novos.

6. Controles Da Exportação. O Programa não pode ser re-exportado, transferido ou ter seus dados descarregados, ou de outra maneira exportado dentro (ou para um nacional ou um residente de) de qualquer país que os E. U. A. embargaram bens, ou para qualquer um na lista do Departamento do Tesouro dos E. U. A. lista de Nacional Especialmente Designados ou do Departamento do Comércio dos E. U. A. na mesa de Ordens de Indeferimento. Instalando o Programa, você está concordando ao antecedente, e está representando e autorizando que você não está situado dentro, sob o controle, de um nacional ou um residente de um país, ou em uma das listas.

7. Garantia Limitada. A Blizzard expressamente desmente qualquer garantia para o Programa, o Editor e o Manual(s). O Programa, o Editor e o Manual(s) são fornecidos " como são " sem garantia do tipo expresso ou implicado, incluindo, sem limitação, as garantias implicadas na mercadoria, aptidão para uma finalidade particular ou sem infração. O risco inteiro que levanta-se fora do uso ou do desempenho do Programa e do Manual(s) remanesce com o Usuário, porém a Blizzard garante até 90 dias da data de sua compra do Programa, os meios que contêm o Programa que devem estar livres de defeitos no material de fabricação. Caso o mesmo apresente defeito durante esse período de tempo, e apresentando a Blizzard a prova da compra do Programa defeituoso, a Blizzard irá em sua opção 1) corrigir qualquer que for o defeito, 2) substituí-lo por um produto de igual ou de menor valor, ou 3) reembolso do seu dinheiro. Alguns Estados não permitem a exclusão ou a limitação de garantias ou de obrigações implicadas para os danos incidentais, assim sendo as limitações acima não podem ser aplicada à você.

8. Limitação de responsabilidade. BLIZZARD, SUA PARELHA, OU SUBSIDIÁRIAS NÃO SERÃO RESPONSÁVEIS EM DE QUALQUER MANEIRA A PERDA OU DANOS DO RESULTADO DO USO DO PROGRAMA OU DO EDITOR INCLUINDO, MAS NÃO LIMITADO A, PERDA DE BENEVOLÊNCIA, PARADA DE TRABALHO, A FALHA OU O MAUL FUNCIONAMENTO DO COMPUTADOR, OU QUALQUER E TODOS DANOS COMERCIAIS OU PERDAS.

9.Medidas Equitativas. Você assim concorda por este meio que a Blizzard seria danificada irreparavelmente se os termos deste Acordo de Licença não forem especificamente impostos e consequentemente você concorda que a Blizzard estará intitulada, sem ligação, a outra segurança, ou prova dos danos, apropriadas medidas equitativas com respeito às rupturas deste Acordo de Licença, além a tais outros medidas que a Blizzard pode de outra maneira ter disponível a ele sob leis aplicáveis.

10. Miscelâneas. Este Acordo de Licença deve ser julgado por ter sido feito e executado no France e toda e qualquer disputa que levantar-se abaixo será resolvido de acordo com a France. Você concorda que toda a reivindicação afirmada na continuação legal por uma das paridades contra a outra deve ser começada e mantida em qualquer Estado ou corte federal situada no France, tendo a jurisdição da matéria sujeita com respeito à disputa entre os partidos. Este Acordo de Licença pode ser emendado, alterado ou modificado somente por um instrumento escrito, especificando tal emenda, alteração ou modificação, executada por ambos os partidos. Caso qualquer provisão deste Acordo de Licença for apreendida por uma corte ou por outro tribunal do jurisdição competente para ser não imposta, tal provisão será imposta à extensão máxima permissível, e as parcelas restantes deste Acordo de Licença remanescerão na força e no efeito total. Este Acordo de Licença constitui e contém o acordo inteiro entre os partidos com respeito à matéria sujeita, e substitui acordos orais ou escritos prévios. Eu por este meio reconheço que eu li e compreendo o Acordo de Licença antecedente e concordo que a ação de instalar o Programa é um reconhecimento de meu acordo ser limitado pelos termos e pelas condições do Acordo de Licença aqui contidos. Eu também reconheço e concordo que este Acordo de Licença é a indicação completa e exclusiva do acordo entre mim e a Blizzard, e que o Acordo de Licença substitui todo o acordo prévio ou contemporâneo, oral ou escrito, e quaisquer outras comunicações entre mim e a A Blizzard.
